    Today we have a special broadcast about estate planning and wills. Brian Haggerty is a lawyer focusing his practice on wills, estate planning, trusts and elder law. Brian graduated with a bachelor’s degree in journalism from Michigan State University in 1979, and earned his Juris Doctor degree, with a certificate in federal tax law, from Northwestern School of Law of Lewis and Clark College in 1997, passing the Oregon bar the following year. In between, Brian spent twelve years as a tax consultant, and keeps current on the tax aspects of his legal work.

  • Creating Your Final Wishes and Legacy Plan

    This trilogy is exploring pre-arrangements and beginning your journey of writing down your final wishes.

    In this episode, Brian talks about several small steps you can take to make sure that your wishes are recorded and followed after you have passed including utilizing a preplanning guide, legacy planning, whether a travel protection plan is right for you and what to do to appoint your next of kin.
    For this episode, Brian talks about the financial side of a pre-arrangement. If you did not fully fund the pre-arrangement, there are several things you can do to help cover the costs for your loved ones. These could include:

    • assigning a life insurance policy to the funeral home
    • providing military discharge paperwork if you served
    • providing tribal information to the funeral home to allow access to tribal funeral benefits
    • providing information for your social security benefits
    • creating a funeral trust
    • creating a dedicated savings account

    If your pre-arrangement was fully funded, here are a few tips and things to consider:

    • Keep a copy
    • Ensure it is fully portable
    • Discuss other costs that may come up regarding your wishes with your funeral home

    If you have already created your pre-arrangement with a funeral home, you may have already discussed what you want to do for your final resting place. With funeral homes that also owned a cemetery or mausoleum, during the pre-arrangement you may have already bought a plot or crypt. If you have not made those plans yet, Brian talks about different ideas to consider when looking at what to do for a final resting place.

This is why it is important to start the conversation about final wishes early. In this episode, Brian talks about what things should be addressed in a conversation about death. He explains what information your funeral director will need to know in an arrangement conference and what to write down during the conversation. He also talks about what items should be brought to an arrangement conference and different documents that would be helpful to have located.
