Acerca de esta escucha
In this instant classic, a veteran prosecutor and award-winning author explains how to ensure key pieces of evidence are admitted in a criminal trial.
Morley Swingle, a veteran of 178 jury trials and 111 homicide cases, provides the foundation “predicate” questions required to successfully present evidence in a criminal trial, from routine fingerprints, DNA, chemical testing results, business records, surveillance recordings, firearms testing, autopsy results, diagrams, blood toxicology, photo lineups, jail calls, drug dog alerts, confessions, and prior convictions, to newer types of evidence like cell tower dumps, geofence warrant results, social media postings, text messages, license plate reader data, cell phone records, GPS location information, digitally enhanced photographs, and hearsay under the forfeiture by wrongdoing doctrine.
Swingle supplies the questions and the legal reasons why those specific questions are necessary.

Knowing the technical bases for objections is not so difficult. Law school covers that. What is much harder is recognizing a good objection very quickly when your opponent puts a question to a witness or starts using a document. Cues and Signals gives you details on every objection that has been recognized in federal courts and sorts out the high-payoff objections from those of lower priority for both oral testimony and exhibits. Everything you need on objections is in one audiobook.

You can get almost any exhibit admitted in evidence by following a few straight forward guidelines that are explained here. The easiest way to explain how to qualify exhibits is to use excerpts from transcripts - the actual questions asked and answers given - in a proceeding in which an exhibit similar to yours was put into evidence successfully. Each point in this guidance is explained this way. By using these examples, you have the structure for your deposition or trial notes.

Great For Law Students
As a second year law student, I listened to Evidence Foundation in Criminal Law in my free time while also taking an evidence course. I can confidently assert that having listened to Mr. Swindle’s book allowed me to deepen my understanding of nuanced evidentiary rules and concepts while doing everyday things like driving to work, running on the treadmill, and sometimes just kicking back and relaxing. I would certainly recommend this book for not only law students, but anyone who wants to gain a better grasp on the foundation rules of evidence. I look forward to listening/reading other titles by Morley Swingle!
