The Case Against Impeaching Trump seeks to reorient the debate over impeachment to the same standard that Dershowitz has continued to uphold for decades: the law of the United States of America, as established by the Constitution. In the author’s own words:

“In the fervor to impeach President Trump, his political enemies have ignored the text of the Constitution. As a civil libertarian who voted against Trump, I remind those who would impeach him not to run roughshod over a document that has protected us all for two and a quarter centuries. In this case against impeachment, I make arguments similar to those I made against the impeachment of President Bill Clinton (and that I would be making had Hillary Clinton been elected and Republicans were seeking to impeach her). Impeachment and removal of a president are not entirely political decisions by Congress. Every member takes an oath to uphold the Constitution of the United States, and the Constitution sets out specific substantive criteria that must be met.

I am thrilled to contribute to this important debate and especially that my book will be so quickly available to readers so they can make up their own minds.”

Even if you hate Trump (and who doesn’t), you should read this book. Dershowitz’s main point is that what we do to Trump today, we’ll do to the next democratic president tomorrow.

Professor Dershowitz lays out a cogent argument that illustrates the legal and constitutional limits to impeach an unpopular President. However, I think his argument for a bifurcated Attorney General misses the mark. As an officer of the United States, the AG swears or affirms allegiance, not to an individual, but to an idea - The Constitution. Therefore there is no need to separate the office into two positions, one loyal to the President and another bound to the law.

In the show John Adams, there's a scene where John Adams is talking to Sam Adams about the upcoming revolution, and Sam says that it's time to take a side. John says, "I'm on the side of the law. Is there another side?" I love Mr. Dershowitz similar impartiality here, and his "if the shoe was on the other foot" test of partisanship. Well written, well thought out, and I think he makes an effective case. He also brings up a lot of questions that the constitution leaves open that I hadn't considered before. Can the president pardon himself? What role does the judiciary play in impeachment? It's interesting to examine these as yet unopened constitutional questions.

A great read, as usual, from Alan Dershowitz. I agree with him 95% of the time and wish more people, on both sides, would think like him. I intentionally waited to hear this one till after the Mueller Report came out so I could see how accurate he was and he pretty much nailed everything. I just hope it's not too late for the folks to wake up. Highly recommend!
