Beneficiary abuse happens to people in all walks of life and usually occurs when you are already grieving the loss of a family member. Our firm, Albertson & Davidson, LLP, has handled hundreds of cases of trustee abuse, and that is just a small fraction of the cases out there. Through this book you will gain insight into the rights you have and some of the actions you can take to stand up and fight back for your inheritance. There is hope. You do not have to suffer beneficiary abuse, but you do have to take action. No one else will fight this battle for you. Your legal rights can only be enforced through your choice to take action.

The book covers the following six main areas where beneficiaries are routinely abused by bad trustees:

  1. Abuse involving the distribution of trust assets;
  2. Abuse involving the provision of trust financial information or accounting to the beneficiaries;
  3. Abuse involving following the trust terms (such as in creating and funding sub-trusts);
  4. Abuse involving the diversification of trust assets;
  5. Abuse involving the unfair treatment of one or more of the beneficiaries; and
  6. Abuse involving a family-owned business.

Each of the six areas is addressed in its own chapter. Each chapter provides a factual scenario to illustrate the typical problem people have with the given abuse area. You will then find recommendations on how we, as trust- and will-focused lawyers, would deal with the problems presented in the factual hypothetical. And finally, you will find a simple-to-understand explanation of the laws that apply to each given topic.

Much needed Info with ADVICE

I think I've read all the books regarding probate, bad executor, trusts. this one stands out because the others May tell you what the law is but they don't give recommendations based on their advice as to the best legal move to make. and that's what one really needs because if you make the wrong move, it might cost you all your money. it would be helpful if the author's addressed other states other than California and whether the California code is also found in the uniform probate code that most states have adopted. Still, it's one of the best books on the subject I found. one topic every book leaves out is the abuse of the vulnerable beneficiary. every book says hire a lawyer but if you're disabled and you make 1500 a month and your rent has gone up 60% at the same time general inflation has gone up 5%.. there is no hiring an attorney. I have four wealthy siblings that have just walked all over me. They all lived close to my parents and I live 300 miles away and my disability doesn't allow me to travel. Just before my father passed at age 91 after hip replacement surgery that occurred by the gross neglect of my sister, they had him redo his will, giving them more and me 1/2 as much as they received. They also so influenced my father that he stopped speaking to me and his granddaughter 6 months before he passed... even though knew that on top of my disability oh, I just been diagnosed with two forms of cancer. Sure I have a case for undue influence but going against attorneys with 20 years of experience, chances are I would lose what little they convince my dad I should have. I hope at the end of the author's next book rather than closing with how much money he made in a particular case, how about hearing how many vulnerable adults he assisted or works to get the law changed where vulnerable adults can get a court appointed attorney for a civil action! great book, the best on the topic.
