Great Book

Senator Mike Lee takes you into the chambers of the Supreme Court as the Justices hear and decides cases. Senator Lee's knowledge of the constitution is obvious from the first chapters. This should be a must read in our schools all across American.

Information is accurate. Storyline is interesting and reasoned. The audio was obviously edit at the lat minute, but generally a good listen.

If you really want a history of the Supreme Court plus a good explanation of 9 Justices on the Court I strongly recommend this book. Mike Lee really understands the workings of the Ciurt.

Stitch in time saves the Nine

Senator Mike Lee puts it quite plainly. The last remaining apolitical body in government will be irreparably harmed beyond repair along with deflating the Constitution to nothing more than a worthless bygone historical document if the Supreme Court is packed.

There was an attempt in 1937 under FDR to pack the court under FDR, but it went no where legislatively because public opinion was against it. FDR tried to pack the court for one reason only and that was to coerce the other justices to be in the majority over “The Four Horsemen” on the Supreme Court and to rule his way. He was tired of the SCOTUS denying him the ability to allow the government to have more control and power that was direly needed to promote his “New Deal” because of the Depression.

FDR was not able to pack the court, but by threatening to do so he was able to influence one of his Justices to rule in his favor. By doing so, that one Justice saved the nine and court packing was not needed.

Eventually, FDR got everything he wanted and more because of his nearly four terms as POTUS and being able to hand pick nearly the entire SCOTUS during his tenure. History will forever remember FDR’s court packing attempt and failure, but it did record the damage that was nearly done in the process to the SCOTUS.

The fact is that Congress only has the legislative power to pack the court. It is easy to do. The other path is much harder because it requires a Constitutional Amendment that requires 2/3 of both house of Congress to agree and 3/4 of all State legislatures to ratify a Constitutional Amendment. But why pull the trigger to pack the SCOTUS? Because it would be in retaliation of a ruling that goes against the narrative of a particular political party.

The kindling to light that fire to do so has ignited already by the reversal of Roe v. Wade just recently and now the Democrats are poised to make this idle threat of packing the court a reality. This 50 year old rule on abortion legality was a poor decision in 1973 because it went against the Constitution’s Tenth Amendment.

Abortion is not ever mentioned in the Constitution therefore the issue has always been up to the States to decide period. The court’s decision was wrong back then and therefore should been overturned. This was never about defending the health rights of woman under the right to privacy or based on the 14th Amendment.

It was reversed because it was wrong from the start and just because some ruling has had longevity for a sustained period of time and has been upheld over and over doesn’t mean it’s right. The “Separate but Equal” argument defending segregation was wrong from the start and was summarily overturned eliminating segregation completely. And even though that was that law of the land for nearly a century doesn’t mean it was right. It’s ruling when it occurred was unconstitutional. Hence, it was rightfully overturned.

Senator Lee provide the above discussions in this book. He did that and more. He also provided his own personal insights not only as a young boy growing with a father who was the US Solicitor General, but as an attorney who argued in front of the SCOTUS, and as a US Senator who brings to life the importance of maintaining the number of Justice’s on the court to continue to maintain the integrity of the three independent branches of government that our Founding Fathers had created for this country.

This is probably one of the most important and timely books to come out. It is an essential tool for anyone wanting to be edified on the SCOTUS and why it’s history is vitality important to structure of our government. To dabble with number of Justices all in the name of promoting a political agenda is a bottle that does not need to be uncorked. Because once it is there will be no end in sight to what will happen. So, that stitch in time will always save the Nine.
