  • Cases of Stigmatized Properties in Real Estate

    Did you know that houses can be shunned? In this episode, Cassie, Ali and Danielle are talking about a few cases, all having to do with stigmatized properties. A stigmatized property is property that buyers or tenants may shun for reasons that are unrelated to its physical condition or features. These can include death of an occupant, murder, suicide, and even the belief that a house is haunted.


    In this episode, they discuss two cases involving home sales where the cause of death of the previous owner was disputed. In Pennsylvania, sellers didn't disclose a murder, leading to a lawsuit, and in Maryland, a buyer sued after finding out the previous owner died in the home.

  • Show Us the Fax! | RZI PROPERTIES, LLC v. SOUTHERN REO ASSOCIATES, LLC | Episode 36

    In 2012, RZI submitted an offer to purchase a property. However, an outdated proof of funds was provided to the buyer, initiating a cascade of problems. Due to a holiday, the buyer couldn't promptly provide the required proof of funds, resulting in poor communication, a missed fax, and ultimately, the loss of the purchase opportunity.

    This bad communication upset RZI and led them to sue the broker that they were working with. Does this instance of poor communication justify legal action?

    Who ya gonna call? Ghostbusters! But in this case, the New York Supreme Court, Appellate Division was the one that was called. In this week’s real estate case, Cassie, Ali and Danielle cover Stambovsky v. Ackley, better known as the Ghostbuster Ruling. 

    The owner of the house advertised their house as haunted by ghosts to the public, but when the buyer wanted to rescind his offer due to the hauntings being unbeknownst to him, they went to the court to get this settled.

    After a slip and fall  on the icy driveway at a vacant for-sale home, prospective buyer Amanda DeSousa sued the homeowners, Matthew and Melissa Fynaardt, and the listing brokerage, Iowa Realty. DeSousa’s slip caused her an injury, but with neither the Fynaardts or the broker on the property at the time of the injury, so who is to blame?
