5-4 is a podcast about how much the Supreme Court sucks. It's a progressive and occasionally profane take on the ideological battles at the heart of the Court's most important landmark cases; an irreverent tour of all the ways in which the law is shaped by politics. Visit fivefourpod.com to learn more.

Presented by Slow Burn co-creator Leon Neyfakh, 5-4 is a production of Prologue Projects.

These days, three degrees of separation from a drug dealer is all it takes to get you drone struck by the U.S. government in Venezuela. And look, maybe these extrajudicial killings aren’t exactly legal, but the bigger problem for all you sissy justice lovers out there is that this administration doesn’t care about the law.

Thank you to our wonderful subscribers who, unfortunately, are at least three degrees of separation from a drug dealer. Watch out.

I think we can all agree that the Constitution guarantees every individual certain unalienable rights–oh wait, sorry, getting a call. Right. Sorry. Okay. Yea. Got it. Hey, so I think we can all agree that immigration law is different from other laws, and the Constitution doesn’t really apply there.

Thank you to our wonderful subscribers. Our love for you will always apply here.

*** An earlier version of this episode incorrectly referred to the asylum officers who conduct credible fear interviews as border patrol agents. ***

If the government is acting all authoritarian-y, detaining you in violation of your rights, there’s a basic assumption in the Constitution that you can use “The Great Writ” of habeas corpus to challenge that unlawful behavior. But Samuel Alito would like to remind you what happens when you ASS U ME. Something something immigrants, something something you’re wrong. So yeah, Constitution HUMILIATED.

These folks know what they're talking about when it comes to case law. Yes, they have a left wing bias, but that is good, because generally so does reality.

Informative and amazing work.

If you're wondering why things in America seem not great right now, these guys break down the historical and current forces for why brilliantly through the lens of exposing the flaws of one of the country's most powerful and under-examined broken institutions. This show frequently leaves me angry, but also more informed. The hosts' colorful, crass humor is a welcome bit of honey to help some miserable medicine go down.

The case covers are really great. I love listening to them and wish I had them while in law school.

The more political ones not connected to cases are extreme and biased to the left. They're so cringy its hard to listen to. They make attacks that make no sense (e.g. tell Alito to come out and say he doesn't know what the flag means but actually did do that, they just don't provide the whole statement).

Their leaps in logic are insane. A flag a wife puts up somehow shows that a justice is a fascist, with no other evidence. But pesky details like Merchan recusals? Never even possibly mentioned.

Case episodes are amazing and a huge service. Political episodes are hack jobs.
