Moreover, the DOJ noted that only high-ranking Justice Department officials—not local prosecutors—could authorize an agreement with nationwide binding effect, which never occurred in this case. They argued Maxwell’s petition does not present any new legal questions or conflicts among federal courts that would warrant Supreme Court intervention, and therefore, her conviction should stand without further review.
