That decision was overturned by the Florida Fourth District Court of Appeal, which unanimously concluded that Hafele had erred in saying he lacked authority to release the records. The appeals court ruled that under state law grand jury records could be made public if doing so would “further justice,” and ordered Hafele (or the trial court) to review the materials and determine which parts could be released with appropriate redactions. In effect, Hafele’s earlier closure was not the final word; the appellate ruling opened the door to unsealing at least portions of the grand jury transcripts, marking a key shift in the long battle over access to these Florida records.
