Most Americans have no idea the IRS has its own internal rulebook — the IRM. And buried inside it is the line they never want you to see. IRM 9.1.3.3 says: “Criminal Investigation’s authority comes from delegated authority.” So if there’s no delegation? There’s no authority. And if there’s no authority? There’s no jurisdiction. Now look at the two statutes they use to prosecute Americans. Section 7203 — willful failure to file. There is no regulation. No delegation. Nothing. Section 7212 — obstruction. The PTAR maps it only to 27 CFR — alcohol, tobacco, firearms excise taxes… not income tax, not private citizens. That means CID prosecutes without the lawful authority the IRM requires.
