2014 fue un hito en la historia de Brasil. Nació la “Operación Lava Jato”, la mayor investigación jamás realizada en el país contra el sistema de corrupción. En 2021, la operación que rompió la regla de impunidad de los ricos y poderosos llegaba a su fin.
En este libro, el exmagistrado Sergio Moro, el mayor representante de Lava Jato, cuenta por primera vez su historia, dedicada al combate del sistema de corrupción. Además de describir a detalle el funcionamiento de este sistema en Brasil, revela los entretelones inéditos de la investigación.
También relata su paso por el gobierno de Jair Bolsonaro y explica por qué renunció a su exitosa carrera en el poder judicial para asumir el cargo de ministro de Justicia y Seguridad Pública. En abril de 2020, desgastado por las tentativas de injerencia del presidente en la Policía Federal, salió por las mismas razones por las que entró: mantenerse fiel a sus principios, proteger el legado de Lava Jato y combatir la corrupción.
Desde entonces, el exjuez ha sufrido diversos embates. En este libro, habla del hackeo a su teléfono celular y a los de los fiscales encargados de la Operación Lava Jato, y del uso de pruebas ilegales y de falsas narrativas para restar credibilidad al trabajo realizado en la operación. Y refuta, uno a uno, los argumentos que llevaron al Supremo Tribunal Federal a considerarlo sospechoso de parcialidad en el juicio al expresidente Luiz Inácio Lula da Silva.
Moro se pronuncia sobre temas fundamentales para el país, como la democracia, el Estado de derecho y los recientes retrocesos en la lucha contra la corrupción. Critica, de manera contundente, lo que llama la “presunción de inocencia brasileña”, una distorsión del sistema judicial diseñada para garantizar la impunidad de los delitos cometidos por la clase dirigente, anulando el principio de que todos deben ser iguales ante la ley.
Pese a los retrocesos, Sergio Moro está convencido de que Brasil ha evolucionado y que la Operación Lava Jato demostró que la corrupción no es el devenir natural de este país. El cambio es posible. El sistema de corrupción es una creación humana, producto de una debilidad institucional y cultural que puede ser superada, siempre que exista la voluntad suficiente para, simplemente, aplicar la ley.
Acerca del autor
Sergio Moro estudió Derecho en la Universidad Estatal de Maringá (UEM), cuenta con una maestría y doctorado por la Universidad Nacional de Paraná. Durante sus 22 años en la judicatura, participó en casos importantes, como juicios contra grandes narcotraficantes de drogas, el Caso Banestado y la Operación Lava Jato. Como juez titular del 13o Tribunal Penal Federal de Curitiba, a cargo de los casos de Lava Jato, ganó renombre internacional. En 2019, fue electo por el Financial Times como una de las 50 personas que marcaron la década.
En 2018, Moro dejó su carrera como juez para convertirse en ministro de Justicia y Seguridad Pública, cargo que ocupó durante un año y cuatro meses. Luego de su salida del gobierno, reanudó su carrera como profesor de Derecho, volvió a dar conferencias y comenzó a escribir una columna en la revista Crusoé.
A partir de 2020, comenzó a trabajar en el sector privado, como consultor en investigaciones corporativas internas y en la planificación e implementación de programas de cumplimiento de la normativa antisoborno y antilavado de dinero, con la finalidad de promover la integridad en el mundo empresarial.
